Terms and Conditions of Sale to Individuals – NEXTMUNE

These general terms and conditions of sale to individuals apply exclusively to sales made on Nextmune’s online store, dermoscent.com.

Article 1: Scope of application

These general terms and conditions of sale to individuals are made available to each buyer on the Nextmune website and apply to every order placed on the said website. Consequently, placing an order implies full and unconditional acceptance of these terms and conditions by the buyer. No general or specific conditions from the client may, without the express agreement of Nextmune, override these terms. Any contrary conditions proposed by the buyer will therefore, without express acceptance, be unenforceable against the seller regardless of when they were communicated.

Article 2: Order placement and confirmation

The client agrees to fill in all required fields (address, delivery address, payment method, etc.). In case of an error in the recipient’s details, Nextmune cannot be held responsible for the inability to deliver the order. Any costs associated with redirecting the package to another recipient or a new delivery address will be borne by the client.

Each product order is subject to acceptance by Nextmune, which reserves the right to reject any order due to insufficient stock, incomplete client information, or any other legal reason.
The customer, after filling in the various fields as indicated on the website, accepts the general terms and conditions of sale by clicking the “PAY MY ORDER” button. Any conflicting terms are unenforceable against the seller, unless formally and expressly accepted in writing by the seller.

Article 3: Delivery

Products are delivered in France and internationally (unless otherwise agreed with our local distributor) via Chronopost to the address provided by the client at the time of order (home delivery or pickup point). Once the carrier takes charge of the order, a tracking number is provided so the client can track their package at any time on the carrier’s website. We encourage clients to regularly check their emails to avoid any inconvenience.

Indicative delivery times after shipment are as follows:

Metropolitan France: 2 to 5 days
European Union: 4 to 8 days
Outside the EU and French overseas territories: 8 to 15 days

 

Shipping costs are displayed before order confirmation.

Nextmune cannot be held responsible for delays in delivery.

 

IMPORTANT: Ensure that delivery details are accurate and complete, and that the recipient is present on the delivery day.

 

In case of the recipient’s absence, a delivery notice will be left in their mailbox by the carrier.
Nextmune cannot be held responsible for failed delivery due to an incorrect address.
If a product is unavailable, we will contact you to inform you of its delivery time.

Article 4: Free shipping in metropolitan France

Free shipping is offered to any client placing a single order of at least €50 including VAT for deliveries in Metropolitan France.

Article 5: Returns / undelivered orders

Home delivery: if the package is returned due to an error or negligence by the client (wrong address, no name on mailbox, absence at delivery, failure to collect the package within the allowed period, etc.), the client will bear the cost of reshipping the order.

Delivery in pickup point: if the client fails to collect the order within seven (7) calendar days from the date it is made available at the pickup point, the order will be returned to NEXTMUNE. The order will then be considered abandoned by the client and cancelled in favor of NEXTMUNE without refund. The client may request reshipment of the order to the address adv@nextmune.com within two (2) months; shipping costs will be borne by the client

Article 6: Right of withdrawal

In accordance with Article L221-5 of the French Consumer Code, you have a withdrawal period of fourteen (14) calendar days from the date of receipt of your order. This right can be exercised without justification.

You must notify Nextmune of your decision to withdraw from this contract via an unambiguous statement by email (adv@nextmune.com) or by mail at the following address:

Simply returning the item without notification or refusing delivery is not sufficient to exercise your withdrawal right. You can use the following template:

In the event of withdrawal, we will refund the full amount of your order within fourteen (14) days from the day we are informed of your decision. Return shipping costs are your responsibility. Refunds will be made using the same payment method used for the original transaction.

You have fourteen (14) days from the communication of your withdrawal decision to return the goods. We will refund upon receipt of the returned package, provided it is in its original condition.

The right of withdrawal applies only to products in their original and complete condition (packaging, contents, accessories, manuals) without signs of use. Products returned incomplete, damaged, partially used, or soiled by the client will not be refunded.

Article 7: Prices

All prices are in Euros, including VAT.

Article 8: Payment

Payment is made exclusively online by credit card.
Accepted cards: VISA, EUROCARD, MASTERCARD.
The payment security system is provided by PAYBOX, ensuring full confidentiality.
The order amount will be debited within 5 days.

Article 9: Product modifications

Nextmune reserves the right to make any changes it deems necessary to its products’ presentation.

Article 10: Holidays

The company reserves the right to close its offices for an annual holiday period, with dates communicated during checkout. During this period, processing, response, and delivery times may be extended. The company will inform clients in a timely manner to minimize impact. No liability will be accepted for delays caused by such closures.

Article 11: Disputes

These terms and conditions are governed by French law. In case of a dispute, the Commercial Court of Castres (Tarn) has exclusive jurisdiction.

In case of dispute, the client should first contact Nextmune to seek an amicable solution.
At the European level, the European Commission provides an online platform for dispute resolution.

Article 12: Effective date

These general terms and conditions of sale to private individuals apply from July 1, 2025.

ANNEXES to the GTC

Article L.211-4 of the French Consumer Code
The seller is required to deliver goods that conform to the contract and is responsible for any non-conformities existing at the time of delivery.
The seller is also responsible for non-conformities resulting from packaging, assembly instructions, or installation when such tasks are assigned to the seller under the contract or carried out under their responsibility.

 

Article L.211-5 of the French Consumer Code
To conform to the contract, the goods must:
 Be suitable for the use normally expected of similar goods, and, where applicable:
Match the description provided by the seller and possess the qualities presented to the buyer in the form of a sample or model;
Possess the qualities that a buyer can reasonably expect based on public statements made by the seller, the producer, or their representative, including advertising or labeling;
Or possess the characteristics mutually agreed upon by the parties, or be suitable for any specific use sought by the buyer, made known to the seller, and accepted by them.

Article L.211-12 of the French Consumer Code
Any claim arising from non-conformity must be brought within two years from the delivery of the goods.

 

Article 1641 of the French Civil Code
The seller is bound by the warranty for hidden defects in the sold item that render it unfit for its intended use, or that so reduce its utility that the buyer would not have purchased it, or would have paid a lower price, had they known of them.

 

Article 1648, first paragraph, of the French Civil Code
Any action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect.
